With regard to:
Articles 9 and 12 of the Spatial Development Planning Principles Act BES, Article 16 of the Island Ordinance Spatial Development Saba 2010 and Article 13 of the Building and Housing Ordinance 1999 Saba;
Considering that:
- •
the Island Council of the Public Entity of Saba must adopt a Spatial Development Plan for the island territory indicating the spatial development to be pursued for the longer term and in which order is made in the distribution of the available space;
- •
a balanced and sustainable spatial development of Saba is paramount, with attention to spatial planning, the natural environment, quality of life and socio-economic development;
- •
with a view to the preparation of a Spatial Development Plan for the territory of the island of Saba, it is desirable to prevent spatial developments that are considered undesirable in view of the objectives to be set by the Spatial Development Plan;
- •
in view of Article 12 section 1 of the Spatial Development Planning Principles Act in conjunction with Article 16 of the Island Ordinance Spatial Development Saba 2010, the Executive Council is authorized to take a preparatory decision;
- •
the Executive Council is authorized on the basis of Article 12 section 2 in conjunction with Article 9 section 3 of the Spatial Development Planning Principles Act to impose restrictions with regard to the construction, the execution of works and activities, in, on or above the land included therein and of the use of that land and the buildings located on it;
- •
a preparatory decision expires if no draft development plan is placed for public review within 18 months of its implementation, with the Executive Council allowed to grant a single extension of up to six months
Decides:

1. To declare as a preparatory decision that a development plan with zoning regulations is being prepared;

2. To prohibit the demolishing of buildings constructed before 1 January 1976;

3. A demolition permit may be granted if the Executive Council determines that demolition is justified in light of:
- a.
concerns for public safety;
- b.
the absence of significant heritage value;
- c.
the overriding public interest in implementing a redevelopment plan;
- a.

4. To notify the decision to the Island Council of the Public Entity of Saba immediately;

5. To publish the decision pursuant to Article 4 of the Island Ordinance Spatial Planning;

6. The decision to be made available for inspection for 30 days at the security desk of the office of the Public Entity Saba. A copy can be made available on request.

7. This decision will enter into force the day after promulgation.
