Island Decree, containing General Measures, regarding the price indication of products offered to consumers (Island Decree on Price indication of Products Saba)

1. The price per unit of measurement shall be expressed in one of the following units of measurement or their decimal multiples or fractions:

• a.

  where the quantity of a product is indicated in volume: 1 cubic meter or 1 liter, it being understood that the unit of measurement 0.1 liter may also be represented as 1 deciliter, 10 centiliters or 100 milliliters;

• b.

  in case the quantity of a product is indicated in weight: 1 ton, 1 kilogram or 100 grams;

• c.

  in case the quantity of a product is indicated in length: 1 meter;

• d.

  in case the quantity of a product is indicated in area: 1 square meter.

2. Where a pre-packaged product consisting of a solid component and a pouring liquid is marked with the draining weight, the indication of the unit price shall refer to the solid component of the product.

1. A seller offers a product, or a sample with which a product is offered for sale, only if it bears an indication of the selling price and the price per unit of measurement.

2. The selling price and the price per unit of measurement need not be indicated for a product, listed in Annex I.

3. Notwithstanding paragraph 1, the unit price need not be stated if:

• a.

  the price per unit of measure of a product is identical to the selling price; or

• b.

  a product is sold in a manner described in Annex II.

3. Notwithstanding the first paragraph, the selling price need not be indicated on products sold in bulk.

1. The indication of the selling price and the unit price of a product, or a sample with the use of which a product is offered, which is present on site, shall be made on, in or near the product or the sample, or on the packaging or on the object, in which it is contained. With respect to each sales price and unit price stated near a product or sample, it shall be clearly indicated to which product this indication refers.

2. The indication of selling price and price per unit of measurement:

• a.

  is comprehensible and unambiguous;

• b.

  is expressed in the currency U.S. dollar;

• c.

  contains, to the extent necessary for a proper understanding of the sales price and unit price, an indication of the sales unit; and

• d.

  is, if necessary after a superficial examination, clearly legible at close range, unless a product or sample is displayed in the manner referred to in paragraph 3.

4. If a product or sample is displayed in a window, the indication of the selling price shall be clearly legible from outside that window.

1. In announcements of price reductions, the seller shall indicate the lowest sales price applied by him during a period not less than thirty days before the application of the price reduction.

1. Notwithstanding the first paragraph, for products of categories designated by Island Resolution Containing General Measures that spoil quickly or have a limited shelf life, the seller may indicate the selling price applied immediately prior to the price reduction.

2. In case a price reduction is progressively increased, the seller may, notwithstanding the first paragraph, for a period up to three calendar months after the commencement of the first price reduction, declare the lowest sales price applied by him for a period not less than thirty days prior to the application of the first price reduction.

3. If a product has been on the market for less than thirty days, the seller may, notwithstanding the first paragraph, indicate the lowest selling price in a period to be specified by the seller.

1. The seller shall provide an invoice or receipt to the buyer immediately upon completion of the sale.

2. The invoice or receipt shall include at least a description per product sold and the selling price of that product.
