The Government- Commissioner in the capacity of Governor as per the Recovery provision Sint Eustatius act;

Whereas:

  • -

    in the Netherlands, but also worldwide, there is a pandemic caused by the Coronavirus (COVID-19);

  • -

    COVID-19 is a group A infectious disease;

  • -

    the Minister of Infrastructure and Water Management decreed to extend the Regeling Tijdelijk verbod burgerlijke luchtvaart luchtruim Bonaire, Sint Eustatius en Saba (Regulation Temporary Ban on Civil Aviation Airspace Bonaire, St. Eustatius and Saba);

  • -

    in pursuance of the Wet publieke gezondheid (‘Public Health Act’), it is of importance to safe-guard the safety and public health of the people of St. Eustatius, and that the Government Commissioner of St. Eustatius based on the aforementioned act is in charge of combatting an epidemic of an infectious disease belonging to group A of infectious diseases;

  • -

    the medical capacity of the hospital and health service is under pressure;

  • -

    in order to prevent further spread of the coronavirus/ COVID-19, the ”Wet tijdelijke maatregelen COVID-19” (Temporary measures COVID-19 act and “Tijdelijke regeling maatregelen COVID-19 Sint Eustatius” (Ministerial regulation temporary measures Covid-19 Sint Eustatius) will go into effect as per December 1st 2020;

  • -

    the aforementioned Act and Ministerial regulation does not regulate the entry to the Public Enti-ty of Sint Eustatius, nor the recommended quarantine in relation therewith;

  • -

    having assessed the Covid-19 pandemic at its present state, it is desirable to have clearly established guidelines to combat the spreading of such;

Condering:

  • -

    The “Wet publieke gezondheid” (Public health act);

The government-commissioner in the capacity Governnor has decided to adopt the following policy regarding guidelines for entry to the territory of Sint Eustatius and therewith related quarantine.

Article 1

For the purposes of this policy it is understood that:

  • -

    residents: citizens with a valid residence permit with Sint Eustatius as their permanent address and those living on Sint Eustatius, who are also registered as such at the Civil Registry;

  • -

    quarantine: residence of a person who may be infected with an infectious disease belonging to group A in a building, ship or in a number of designated areas within it, designated by the Government Commissioner, in connection with the control of the dangers of that disease to the public health;

  • -

    Low-risk area: areas that have a comparable favorable epidemiological situation as Sint Eustatius (in its state of non or low alert);

  • -

    Medium-risk area: do not have a comparable favorable epidemiological situation as Sint Eustatius. There is (increased risk of) local transmission of Covid-19;

  • -

    High-risk areas: areas do not have a comparable epidemiological situation as Sint Eustatius. There is community transmission of Covid-19, and the risk of infection and introduction by travelers from this area is high.

Article 2

  • 1. With due regard to the Regeling Tijdelijk verbod burgerlijke luchtvaart luchtruim Bonaire, St. Eustatius en Saba, in connection with the virus that causes the COVID-19 disease, it is forbidden to enter St. Eustatius or to facilitate entry, in whatever way, of citizens who are not residents of St. Eustatius, except in the cases where the Government-commissioner has granted pre-approval for entry.

  • 2. The Government Commissioner has the authority under application of the “Wet publieke gezondheidszorg (Public health act) to oblige citizens, who entered the territory of Sint Eustatius to be quarantined and/or to undergo Covid-19 testing.

  • 3. All non-residents, desiring to enter Sint Eustatius must request approval from the Government Commissioner prior to their departure from the port of embarkation.

  • 4. All residents coming from a medium or high-risk area, must request approval to enter or reenter Sint Eustatius, prior to their departure from the port of embarkation.

  • 5. All residents coming from a low risk area should inform the Government-commissioner of their intention to enter or reenter, prior to their departure from the port of embarkation.

  • 6. Exemptions can be made, under strict conditions/guidelines for persons returning from traveling for medical care from medium or high-risk areas.

  • 7. The Government-commissioner may provide a contact person through which the request for approval of intention of travel is to be directed.

Article 3

  • 1. Persons traveling direct to Sint Eustatius from low-risk areas can travel to Sint Eustatius without additional testing and quarantine requirements.

  • 2. All persons travelling from medium-risk areas must quarantine upon arrival on Sint Eustatius.

  • 3. Persons traveling from high-risk areas must test before and after arrival and go into quarantine upon arrival.

  • 4. An overview of the low-, medium- and high risk areas are published on the government website: statiagovernment.com.

Article 4

  • 1. Encumbered with the supervision on compliance with this policy are the Police officers and the Royal Netherlands Marechaussee and public servants designated for this purpose by the competent authority.

  • 2. Any and all instructions given by them for the enforcement of this policy must be observed promptly and immediately.

Article 5

Any act in violation of the guidelines given by virtue of this policy may result in application of articles 31 and 35 of the “Wet publieke gezondheid” (Public Health act)

Article 6

The aforementioned prohibitions / orders are not applicable to:

  • 1.

    the emergency services, the people, designated by the Government Commissioner.

  • 2.

    The Government Commissioner may attach regulations and restrictions to an exemption or dispensation on the basis of the first paragraph.

Article 7

This policy takes effect immediately on December 1st 2020 and remains in full force and effect up to the moment that it is repealed.
