Whereas

  • -

    in the Netherlands, but also worldwide, there is a pandemic caused by the Coronavirus (COVID-19);

  • -

    COVID-19 is a group A infectious disease;

  • -

    the Minister of Infrastructure and Water Management decreed on April 10th, 2020, to extend the Regeling Tijdelijk verbod burgerlijke luchtvaart luchtruim Bonaire, Sint Eustatius en Saba (Regulation Temporary Ban on Civil Aviation Airspace Bonaire, St. Eustatius and Saba) until April 28th, 18:00 hours local time (Stcrt 10 april 2020, no 21917);

  • -

    the government-commissioner by emergency decree of March 27th , April 3rd and April 15th 2020, has declared all ports closed for passenger travel;

  • -

    there are meanwhile people on St. Eustatius with coronavirus / COVID-19;

  • -

    the Government Commissioner of St. Eustatius, in pursuant to chapter 5 paragraphs 2 and 6 of the Public Health Act (Wet publieke gezondheid), provides for the prevention of an epidemic of an in-fectious disease belonging to group A of infectious diseases;

  • -

    the medical capacity of the hospital and health service is under pressure;

  • -

    in order to prevent further spread of the coronavirus/ COVID-19, protocols were set in place on March 26th and April 6th and 7th by the maritime sector, for vessels other than the cargo vessels coming to the city pier;

  • -

    it is desired to have the procedures established by the abovementioned protocol, adopted into an official regulation;

Decides to adopt the following Regulation regarding the execution of the Public Health Act in connection with COVID-19 for vessels other than cargo vessels coming to the city pier Besluit houdende algemene maatregelen.... /// Eilandsverordening

Hoofdstuk 1

Paragraaf 1

Article 1 Reporting duty

  • 1. The master of ship shall, in accordance to the International Health regulations (IHR 2005 art 37), deliver the Maritime Declaration of Health prior to arrival in our ports the ships visited within the previous thirty days.

  • 2. All crew or passengers that have joined the ship within the last thirty days, shall be reported to the port authority in accordance with the IHR.

  • 3. The reports mentioned in paragraph 1 and 2 of this article are to be conveyed to the harbor master through the usual channels.

Article 2 Precautions

Anyone boarding any ship travelling from international waters must:

  • a.

    put on PPE, meeting at least the minimum requirement of N95 or FFp2 face mask or respirator, close eye goggles, gloves (nitril x-long, bio hazard), and a Hazmat suit. Failure to comply with this will result in admission to the ship being denied.

  • b.

    avoid meeting with ship’s crew in closed quarters where ventilation systems might recirculate air, and remain on deck.

  • c.

    keep a safe distance of one and a half meters from the nearest person at all times.

  • d.

    wash hands prior to and after boarding with soap or sanitize with alcohol.

  • e.

    maintain proper sneezing etiquette by sneezing in a tissue or elbow.

Article 3 Category ships

  • 1. Ships falling under this regulation can be placed in one of the following categories:

    • a.

      Type 1

    • b.

      Type 2 low risk.

    • c.

      Type 2 high risk.

  • 2. The ships are placed in the categories by the Public Health department based on the reports provided under article 1.

Article 4 Access prohibited

  • a.

    At no point will anyone be allowed to board a type 1 or a type 2 high risk vessel.

  • b.

    The following persons, entities or representatives thereof are not allowed to board type 2 low risk vessels: ship’s agents, bunker masters, jetty dock masters.

  • c.

    The Shipping Inspectorate and Health department will only board a type 2 low risk vessel for an investigation.

Article 5 Type 1 vessels

Exchange of documents and samples required for type 1 vessels will only be done by buckets and communication shall only be done via VHF-radio.

Article 6 Persons allowed on type 2 low risk vessels

Persons who are allowed to board type 2 low risk vessels:

  • a.

    Cargo representatives, sample takers from: Emspac, Calebret / Intertech, Petromar, General Maritime.

  • b.

    Persons in charge (PIC), Progressive Enterprise, on the monopile and barge floating hose station.

  • c.

    Pilots to bring the ships in and out.

Article 7 Requirements and restrictions type 2 low risk vessels

  • 1. The amount of persons, the time onboard and the interaction with the crew is to be reduced to the minimum..

  • 2. Boarding time of all persons, with the exceptions of the pilots, is not before 07.00hours and everybody has to leave the vessel before 18.00 hours.

  • 3. Only pilots may go onboard in the dark hours.

  • 4. Docking and undocking, with only the pilots onboard the vessel, is allowed 24/7.

  • 5. No visitors are allowed on the tug boats and the barges.

Article 8 Quarantine

  • 1. Vessels that fall in the category of type2 high risk will be placed under quarantine.

  • 2. During the period of quarantine no one is allowed to go on board the vessel, neither is the captain or any crew member allowed to disembark.

Article 9 Implementation

This regulation goes into effect immediately upon publication.

Annex to the “Corona protocol for vessels other than the cargo vessels coming to the city pier” of 26 March 2020

Discussed and agreed in the meeting of 30 March 2020

Who are allowedto board type 2 low risk vessels:

  • 1)

    Cargo representatives, sample takers from: Emspac, Calebret / Intertech, Petromar, General Maritime

  • 2)

    Persons in charge (PIC), Progressive Enterprise, on the monopile and barge floating hose station

  • 3)

    Pilots to bring the ships in and out

Requirementsandrestrictions:

  • 4)

    Nobody will board a type 2 low risk vessel without: gloves, goggles, coverall and face masks

  • 5)

    The amount of persons, the time onboard and the interaction with the crew to be reduced to the minimum. The safe distance of 1,5 meter to be kept at all times

  • 6)

    Nobody, with the exception from the pilots, goes onboard in the dark hours, this is to make sure that the ship management is awake and vigilant for the visitors to wear their PPE; no PPE is no admission

  • 7)

    That means boarding time of all persons, with the exceptions of the pilots, not before 07.00 and everybody to leave the vessel before 18.00.

  • 8)

    Docking and undocking, with only the pilots onboard the vessel, is allowed 24/7

  • 9)

    Discussed and agreed in two former meetings: no visitors allowed on the tug boats and the barges

Who are no longerallowedto board type 2 low risk vessels:

  • 10)

    Ships agents, bunker masters, jetty dock masters

  • 11)

    The Shipping Inspectorate and Health department will only board a type 2 low risk vessel for an investigation
